Last week, we brought you the story of forestry worker, Shane Holmes, fighting for ACC compensation for what he believes is a work-related injury to his back. Since then, ACC has received independent reports from medical specialists including Shane's orthopaedic surgeon as well as a spinal specialist.
ACC says it's been confirmed. Shane's current incapacity is related to a pre-existing condition.It says, for that reason, it's unable to provide cover given that there was no medical link to Shane's claim.
A spokesperson for the commission says ACC definitely feels for Shane and his whānau, especially given the complex medical nature of his condition and the resulting financial hardship.
Shane's whānau say they're disappointed with the decision and are considering appealing.
